Downsizer contributions will soon be with us. Draft legislation to implement the budget proposal to permit over 65’s to contribute up to $300,000 towards their super has now been released. The big issues are whether your clients are eligible to make downsizer contributions and, if eligible, whether they should make downsizer contributions. Should downsizer contributions be made to a trust? By means of a number of different scenarios the eligibility for and desirability of downsizer contributions will be considered and illustrated.

Family trusts are important for business, estate planning and increasingly retirement planning as the government continues to limit contributions to super. As with SMSF’s, family trusts need to be regularly updated for changes in the laws. But whereas updating a SMSF deed is often a simple matter of replacing it with a “brand new” deed, to amend a family trust involves specific tailored amendments. ASIC has stated that starting a SMSF with less than $200,000 is unlikely to be in the client’s best interest.
Effectively the regulator is saying that clients cannot look after their own superannuation and must pay a third party to do so, at material detriment to their ultimate super account balance.
